  • contact the customer to confirm whether they wish to proceed at the correct price.

If payment has already been received for an order cancelled due to an obvious pricing error, a full refund of the amount paid will be issued.

16. Orders

Submission of an order through the Website constitutes an offer by the customer to purchase goods.

Submission of an order does not constitute acceptance by CineCiti.

A contract of sale is formed only when CineCiti confirms acceptance of the order by dispatching the goods or otherwise confirming acceptance in writing.

Until that time, CineCiti reserves the right to refuse or cancel any order for any lawful reason.

17. Refusal of Orders

CineCiti may refuse or cancel an order where reasonably necessary, including where:

  • products are unavailable;
  • pricing errors have occurred;
  • payment cannot be verified;
  • fraudulent activity is suspected;
  • export restrictions apply;
  • supplier allocations prevent fulfilment;
  • the customer has provided incorrect information;
  • the customer has breached these Terms; or
  • compliance with applicable laws requires cancellation.

Where an order is cancelled before dispatch, any payment received will be refunded in accordance with the original payment method where practicable.

18. Special Orders

Certain products are identified as Special Order products.

Special Order products include, but are not limited to:

  • products specifically imported for a customer;
  • customised products;
  • non-standard inventory;
  • products sourced directly from manufacturers on request.

Special Orders are subject to separate lead times.

Estimated delivery dates are indicative only.

Further terms relating to cancellation, deposits and refunds are set out in the applicable Returns Policy.

19. Pre-Orders

CineCiti may accept orders for products not yet released or not currently in stock.

Estimated arrival dates are supplied by manufacturers and may change without notice.

Production delays, shipping delays, customs clearance or supplier allocation may affect availability.

CineCiti will make reasonable efforts to keep customers informed of significant delays but does not guarantee any particular release or delivery date.

20. Promotions

From time to time CineCiti may offer promotions, discounts, bonus items or special offers.

Unless otherwise stated:

  • promotions cannot be combined;
  • promotions are available only while stocks last;
  • promotions may be withdrawn or amended without notice;
  • promotional offers have no cash value;
  • bonus items cannot be exchanged for cash or credit.

Where multiple promotions could apply to the same purchase, CineCiti reserves the right to determine which promotion applies.

21. Promotional Codes

Promotional codes are subject to their individual terms and conditions.

Unless otherwise specified:

  • only one promotional code may be used per order;
  • promotional codes cannot be redeemed for cash;
  • promotional codes cannot be applied retrospectively after an order has been placed;
  • promotional codes may not apply to excluded products or brands.

CineCiti reserves the right to cancel promotional codes that have been issued in error or used fraudulently.

22. Gift Cards (if applicable)

Gift Cards issued by CineCiti:

  • are redeemable only through approved sales channels;
  • are not redeemable for cash;
  • cannot be exchanged for another Gift Card;
  • may not be replaced if lost or stolen unless required by law.

Additional Gift Card conditions may apply and will be published at the time of issue.

The Website may contain links to third-party websites.

Such links are provided solely for convenience.

CineCiti does not control or endorse third-party websites and accepts no responsibility for their content, products, services, privacy practices or security.

Access to third-party websites is entirely at your own risk.

Unless required by law, CineCiti accepts no responsibility for loss arising from incorrect installation, configuration, operation or maintenance of professional equipment.

26. Manufacturer Changes

Manufacturers may modify products after publication without notice.

  • firmware;

  • accessories;
  • colour;
  • packaging;
  • included items;
  • country of manufacture.

Unless required by law, CineCiti accepts no responsibility for manufacturer changes implemented after publication of Website information.

Such events include, but are not limited to:

  • government actions;
  • war;
  • civil unrest;
  • industrial disputes;

  • supplier failures;
  • transport disruptions; and
  • acts of God.

During such events, CineCiti may suspend, delay or cancel affected orders without liability.

31. Invalid Provisions

If any provision of these Terms is found to be invalid, unlawful or unenforceable by a court of competent jurisdiction, that provision shall be severed from these Terms.

The remaining provisions shall continue in full force and effect.

32. Waiver

Failure by CineCiti to exercise or enforce any right under these Terms does not constitute a waiver of that right.

Any waiver must be in writing and signed by an authorised representative of CineCiti.

33. Governing Law

These Terms are governed by the laws of the State of New South Wales, Australia.

You irrevocably submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia in relation to any dispute arising under these Terms.
